A 20 year-old young man has pleaded not guilty to slapping his then 18 year-old girlfriend over a missing cellular phone.
Kenny Duncan was arraigned in court today, February 8 for the offence of common assault. Duncan, who does not have a lawyer, was granted $30,000 bail signed with one surety and ordered to stay away from the complainant.
Prosecutor Valston Graham told the court that the complainant and the defendant were in an intimate relationship at the time of the incident, which took place in July of last year.
According to the allegations, on the date in question, the complainant along with her sister and the defendant were attending a high school function at The Moorings. Whilst there, she could not locate her cellular phone which she was using sometime at the event.
Graham said the complainant then asked Duncan for the phone and he got angry and told her it was good that she couldn't find the phone since she was busy texting a man.
The couple got into an argument and Duncan allegedly slapped the young lady.
A report was made to the police station. While at the scene, the police officer observed that the complainant's face was swollen. It is alleged that Duncan told the police that he did hit the complainant.
Graham said while the officer was present, Duncan was behaving in an aggressive manner to the complainant. He said Duncan was taken into custody for a "cooling off" period.
Duncan, who attended court on a summons, will stand trial on April 12. He indicated that he is no longer involved with the complainant.
