(PLTM) - A deportation order has been issued for Derek Cort, a Guyanese native who was convicted in 2010 and sentenced to 10 years in prison for rape.

Governor John Duncan made the order on January 6.

"...Do hereby order the said Derek Cort to leave the Territory of the Virgin Islands on or before the expiration of seven days from the date on which a copy of this order is served on him by an immigration officer or a police officer, and thereafter to remain out of the Territory."

Further, the order noted, "And I do further order that the said Derek Cort be placed on board the first available ship or aircraft about to leave the Territory and that the said Derek Cort may be detained until he is placed on a ship or an aircraft, unless he appeals to the Governor in writing against the making of this order before the expiration of the said period of seven days."

In May 2010, a nine member jury unanimously found Cort, who is in his early 50's, guilty of raping his ex-girlfriend on August 6, 2008 at her Virgin Gorda (VG) apartment. He was sentenced to 10 years in prison by former resident Judge, Madame Indra Hariprashad-Charles.

It was the crown's case that Cort and the woman were in a relationship, but they ended it in July 2008. However, on the night of August 6, 2008, Cort entered the woman's VG apartment without her permission while she was on the telephone.

Prosecution contended that he then attacked, threatened her with a knife and raped her.
